ISSUISSUES FOR CONSIDERATION FOR TAKING POSITIONS
ON NEW ALCOHOL OUTLETS

1) Level of "undue concentration: This is a finding made by the State ABC. It does not include how many outlets over the limit is the census tract for on and off sale.

Step 1: If outlet census tract is over-concentrated why should any more be allowed? If answer is no then Oppose the permit.

Step 2: If yes, then one or more of the following conditions must be met: (VAPC must answer what exceptions are acceptable in an over-concentrated census tract)

2) How close is the proposed site to a residential neighborhood? Can you set a distance that is the same for all neighborhoods? Does the kind of outlet matter (ie: on or off sale)? What if the neighborhood wants an outlet?

Step 1: If the outlet is closer than _____ ft. then Oppose the permit (VAPC must determine if a set distance is to be used.)

Step 2: If not closer than _______ft. Then what specific conditions must be met to Not Oppose the permit?

3) How close are other outlets? We have a 1000' distance requirement between outlets unless the outlet is a restaurant.

Step 1: If there is another outlet (not including restaurants) the permit should Opposed the permit.

Step 2) If VAPC chooses not to oppose in spite of the 1000' distance requirement the following conditions must be met.

4) Are there similar businesses already in the area? Does the area need another similar business selling alcohol? Does opposing the sale of alcohol put the outlet at a competitive disadvantage?

Off-sale Outlet

Step 1: If there is a similar off-sale outlet within _________ ft. then the VAPC will Oppose the permit.

Step 2: If there are no other similar businesses then the following conditions must be met in order to Not Oppose the permit.

On-sale Outlet

Step 1: If there is a similar on-sale outlet within _________ ft. then the VAPC will Oppose the permit.

Step 2: If there are no other similar businesses then the following conditions must be met in order to Not Oppose the permit.

5) Is alcohol normally part of the business? Should a gas station sell alcohol? What about a restaurant with alcohol service.

Step 1: If the business does not normally sell alcohol the VAPC should Oppose the permit.

Step 2: If the business normally includes alcohol then the following conditions must be met in order to Not Oppose the permit.

 

6) What is the history of alcohol-related problems in the area? Have there been many police calls? Is there signs of public drinking around the area? Is the area blighted?

Step 1: If the area has a history within the last year of numerous calls for service, especially if the calls area alcohol or drug related the VAPC should Oppose the permit.

If the area is blighted or shows signs of alcohol or drug use in the area the

VAPC should Oppose the permit.

 

 

 

Step 2: If there are not significant calls for service or other signs of alcohol or drug use in the area then one or more of the of the above "step 2" factors must exist to Not Oppose the permit.

 

 

7) Are there potential benefits to the community? Does this store create improvement in the area?

Step 1: If we cannot find any benefit we will Oppose.
